Welcome to CampusBiz Careers. By accessing or using our platform, you agree to be bound by these Terms of Service. These terms govern the relationship between CampusBiz (the "Platform"), Job Applicants ("Applicants"), and Employers/Recruiters ("Employers").
These Terms compliment the General Terms that govern the use of CampusBiz Platform as described Here.
1. General Provisions & Nature of Service
CampusBiz Careers provides a digital bridge between talent and opportunity. CampusBiz Careers acts as an intermediary platform connecting job seekers with potential employers.
- Informational Purpose Only: All job listings, descriptions, and company profiles provided on this platform are for informational purposes only. CampusBiz does not guarantee the accuracy, legitimacy, or availability of any position listed.
- No Employment Relationship: Nothing on this platform creates an employer-employee relationship between CampusBiz and any Applicant.
1.1 Data Protection Compliance
In accordance with the Data Protection Act, 2019 (Kenya), CampusBiz Careers acts as a Data Controller for platform account data and a Data Processor regarding the specific application files managed through our ATS on behalf of Employers.
2. Terms for Applicants
2.1 Account Responsibility
Applicants must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials.
2.2 Employer Use of Data
By using our application system, you acknowledge that your data is being transmitted to a third-party Employer.
- Liability Waiver: CampusBiz is not liable for how an Employer handles, stores, uses, or misuses your personal data once they have received your application. Once transmitted, the Employer becomes an independent Data Controller of your information.
2.3 External Applications & Third-Party Links
Some job listings may redirect you to external websites, Google Forms, or third-party ATS platforms.
- Disclaimer: CampusBiz has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites.
- Assumption of Risk: If you choose to apply via an external link, you do so at your own risk. Our 90-day data retention policy and privacy protections do not apply once you leave the CampusBiz domain.
2.4 Data Processing & Consent
By submitting an application, you expressly consent to:
- The collection and processing of your personal data (including name, contact details, CVs, Cover letters and any other document you use to apply for roles on CampusBiz).
- The sharing of this data with the specific Employer to whom you applied.
- The use of automated tools (ATS) to filter or sort applications based on criteria set by Employers.
2.5 The 90-Day Retention Rule
To ensure your "Right to be Forgotten" and to maintain data minimisation as per ODPP guidelines:
- All application data, uploaded CVs, and files are stored for a maximum of 90 days.
- After 90 days, or when the role is deleted by an employer or CampusBiz, whichever comes first, your application records for that specific role will be permanently deleted from our active ATS database.
- No Backups: CampusBiz does not maintain "shadow copies" or backups of deleted applications. Applicants are advised to keep their own records.
3. Terms for Employers
3.1 Lawful Processing & Data Stewardship
Once an application is received through CampusBiz or exported by you, you assume full legal responsibility as a Data Controller under the Data Protection Act, 2019 of Kenya.
- You agree to indemnify CampusBiz against any claims arising from your mishandling of applicant data or breaches of confidentiality occurring within your own systems or organization.
3.2 Usage & Security
- Employers are granted access to the CampusBiz Careers Dashboard to manage candidates and job posts.
- Employers must implement adequate technical and organizational measures to protect applicant data accessed via the platform.
- Data Purge: Employers acknowledge that applicant files are automatically deleted after 90 days. If you require longer retention for legal or administrative reasons, you must export and store such data in your own compliant environment, ensuring you have a lawful basis to do so.
4. Privacy and Data Rights
All users hold the following rights:
- Right to be Informed: Transparent notice of how data is used (provided herein).
- Right of Access: You may request a copy of the personal data we hold about you.
- Right to Rectification: You may update inaccurate or incomplete data via your dashboard.
- Right to Erasure: You may request the deletion of your data prior to the 90-day expiry.
5. Subscriptions and Payments
CampusBiz Careers operates on a subscription-based model. By purchasing a Job Package or Subscription, you agree to the following:
5.1 Subscription Packages
- User Responsibility: It is your sole responsibility to review and select the correct package for your needs. CampusBiz is not responsible for accidental purchases of higher-tier plans, double or duplicate orders, or incorrect package selections.
5.2 Financial Data Protection (Kenya DPA 2019)
In accordance with the Data Protection Act:
- Payment Processing: CampusBiz does not store full credit card or bank details on our local servers. All payments are processed via secure third-party gateways.
- Transaction Records: We retain records of your subscription history and billing address for tax and accounting purposes in accordance with Kenyan Law.
5.3 The 14-Day Free Trial
- We offer a 14-day free trial for new applicants.
- Automatic Billing: Where applicable, unless cancelled before the end of the 14th day, the trial will automatically convert into a paid subscription, and your saved payment method will be charged the full amount of the chosen plan.
- Trial Limit: Trials are limited to one per user/entity. Creating multiple accounts to exploit the trial period is a violation of these terms and may lead to a permanent ban.
5.4 Strict "No Refund" Policy
- All sales are final. Due to the digital nature of our services and the immediate access to our database/ATS tools, CampusBiz does not offer refunds for any reason, including but not limited to:
- Failure to hire a candidate.
- Lack of applications.
- Accidental subscription renewals.
- Changing your mind after purchase.
- If you wish to stop a subscription, you must cancel it via your dashboard before the next billing cycle.
6. Platform Availability & Downtime
While we strive for 99.9% uptime, we are built on third-party infrastructure.
- No Liability for Downtime: CampusBiz Careers shall not be held liable for any service interruptions, server downtimes, or maintenance periods.
- We do not offer credits or extensions to subscriptions for time lost due to technical outages beyond our control.
7. Comprehensive Limitation of Liability
To the maximum extent permitted by Kenyan law:
- No Liability for Loss: CampusBiz Careers, its parent company, and affiliates shall not be held liable for any loss whatsoever—including but not limited to loss of income, data, time, reputation, or any indirect or consequential damages—arising from the use of this platform.
- No Guarantee of Employment: We do not guarantee that using this platform will result in an interview or a job offer.
- Vetting Disclaimer: While we strive to maintain a high-quality jobs platform, we do not perform exhaustive background checks on every Employer. It is the Applicant's responsibility to perform due diligence before sharing sensitive information or attending interviews.
8. Termination
We reserve the right to suspend or terminate any account or subscription that violates these terms, including the misuse of data or fraudulent posting of jobs, without a refund.
9. Governing Law
These terms are governed by and construed in accordance with the Laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan Courts or the Office of the Data Protection Commissioner (ODPP).
